Terms & Conditions | Brightmore Tutoring

Brightmore Tutoring Ltd

Terms & Conditions

Please read the terms below carefully. They explain the conditions that apply to Brightmore Tutoring programmes, payments, lessons, resources and programme access.

These Terms & Conditions apply to tuition programmes and services provided by Brightmore Tutoring Ltd.

01

Payment

  • If a programme or package is purchased, the parent/guardian is committing to the agreed programme length and programme price. Where payment is split into monthly instalments, this is a payment plan towards the agreed programme and should not be treated as a monthly rolling subscription.
  • All fees must be paid in advance of lessons.
  • All payments are non-refundable once services have commenced, except where the parent/guardian has a statutory right to a refund under applicable UK consumer law. Exceptions may also be made at the discretion of Brightmore Tutoring Ltd management in exceptional circumstances.
  • Where a parent/guardian requests for tuition services to begin immediately, Brightmore may begin providing those services during any applicable statutory cancellation period.
  • Where digital content and resources are made available immediately following enrolment, the parent/guardian may be required to expressly consent to receiving immediate access and acknowledge the effect this has on their statutory cancellation rights.
  • Parents/guardians cannot cancel during the first 3 months of their programme, subject to any statutory cancellation rights which cannot legally be excluded.
  • Following the initial 3-month commitment period, parents/guardians may cancel their programme by providing one month’s written notice by email. Payments due during the notice period remain payable.
  • Failure to attend lessons does not constitute cancellation. Cancellation must be submitted by the contracting parent/guardian via email.
  • All payments must be made on time, including payments that have been split into instalments.
  • If a payment becomes more than 3 days overdue, a £15 late-payment fee may be applied where permitted by applicable law.
  • After 3 days of non-payment, Brightmore Tutoring Ltd reserves the right to suspend the student’s access to live tuition, recordings, Togever, learning resources and any other programme benefits until the outstanding balance has been paid.
  • Where a payment fails and the parent/guardian does not communicate with Brightmore regarding when payment will be made, the student’s access to lessons and programme services may be suspended immediately.
  • Where the parent/guardian has authorised recurring payments, Brightmore Tutoring Ltd reserves the right to use its payment provider, including Stripe, to retry failed payments or collect overdue contractual instalments from the authorised payment method in accordance with the payment authority provided.
  • If a student exceeds the number of 1:1 lessons, tuition hours or additional services originally purchased, the parent/guardian will be liable for the additional fees. These must be settled promptly in line with our payment terms.
  • Monthly payments are calculated based on the overall programme and should not necessarily be treated as payment for a specific number of lessons within that calendar month.
  • Scheduled Christmas, Easter, summer and other programme breaks may already be accounted for when calculating the overall programme price. Parents will therefore not automatically receive a reduction in their monthly payment during months containing scheduled programme breaks.
  • Nothing in these Terms & Conditions is intended to exclude or restrict any statutory rights that a customer is entitled to under applicable UK consumer law.

02

General (Group Tuition)

  • Students are expected to maintain at least 95% attendance throughout their programme.
  • Students are expected to attend lessons on time, participate in class, behave appropriately, follow their tutor’s instructions and complete all homework and assessments provided.
  • Students must complete any end-of-month examinations or progress assessments included within their programme.
  • If a student misses their scheduled group lesson, they may request to attend another suitable Brightmore lesson during the same week, subject to availability.
  • If another suitable group lesson is not available that week, the student will be expected to catch up by watching the lesson recording.
  • Missed group lessons are not eligible for refunds.
  • If a student is late for a group lesson, the lesson will still finish at the scheduled time and the student will not be entitled to a refund, additional tuition time or a replacement lesson.
  • Brightmore Tutoring Ltd reserves the right to substitute a tutor due to sickness, absence, availability, staffing changes or other reasonable circumstances.
  • Where reasonably possible, Brightmore will provide notice of tutor changes.
  • Brightmore may reasonably change a student’s group, tutor or regular lesson time where operationally or academically necessary. Where possible, at least 24 hours’ notice will be provided for planned timetable changes.
  • If Brightmore or a Brightmore tutor cancels a scheduled lesson, a replacement lesson will be provided.
  • Brightmore will provide the tuition, resources and academic support included within the student’s programme but cannot guarantee a particular GCSE grade, grade increase, examination result, predicted grade, school placement or other academic outcome.
  • Brightmore cannot be held responsible for reduced progress where a student repeatedly fails to attend lessons, complete homework, participate in class, sit assessments or follow the academic guidance provided.

03

General (1:1 Tuition)

  • At least 24 hours’ notice must be provided if a student needs to cancel or reschedule a 1:1 lesson.
  • Where at least 24 hours’ notice is provided, Brightmore will arrange an alternative lesson subject to tutor availability.
  • Cancellations made with less than 24 hours’ notice will result in the lesson being forfeited and the parent/guardian will still be required to pay for that lesson.
  • If a student fails to attend a 1:1 lesson without providing the required notice, the lesson will be treated as a no-show and no replacement lesson or refund will be provided.
  • If a student arrives late, the lesson will still finish at its originally scheduled time and the missed time will not be added to another lesson.
  • If Brightmore or the allocated tutor cancels a 1:1 lesson, Brightmore will guarantee a replacement lesson.

04

Togever & Programme Access

  • Students enrolled on an eligible Brightmore programme will be provided with access to Togever as part of their programme.
  • Togever may provide access to live lessons, recordings, homework, attendance information, learning resources, messages and other educational features.
  • Access to Togever forms part of Brightmore’s method of delivering and supporting its tuition programmes and should not be treated as a separately purchased standalone service.
  • Togever may occasionally be unavailable due to maintenance, technical faults, third-party service issues, updates or circumstances outside Brightmore Tutoring Ltd’s reasonable control.
  • Temporary downtime, technical problems or interruptions affecting Togever will not, by themselves, entitle a customer to a refund, cancellation of outstanding instalments or reduction of tuition fees where Brightmore continues to provide the paid tuition services and essential learning materials are made available by reasonable alternative means where necessary.
  • Brightmore may update, replace or change the platform or digital systems used to provide its programmes where reasonably necessary for educational, operational, security or technical reasons.
  • Togever login details are restricted to the enrolled student and their parent/guardian.
  • Login details must not be shared with siblings, friends, other students or any other unauthorised person.
  • Brightmore reserves the right to suspend platform access where account sharing or unauthorised use is identified.

05

Online Lessons & Recordings

  • All online classes may be recorded for educational, safeguarding, quality assurance, training and student revision purposes.
  • Lesson recordings may include a student’s name, voice, image, participation, chat messages and shared academic work.
  • Recordings may be made available to other enrolled students and parents within the same class for revision and catch-up purposes.
  • Lesson recordings will normally be retained for up to 90 days after the lesson before being permanently deleted, unless a longer retention period is reasonably required for safeguarding, complaint or legal purposes.
  • Students are required to keep their cameras switched on during live lessons for safeguarding, attendance monitoring, engagement, identity verification, classroom management and teaching purposes.
  • Where a parent/guardian believes their child requires a camera exemption because of safeguarding concerns, medical circumstances, legal restrictions, court orders or other exceptional circumstances, they must contact Brightmore Tutoring Ltd in writing before lessons commence so that appropriate arrangements can be considered.
  • Students, parents and attendees are strictly prohibited from taking screenshots, photographs, screen recordings or independent recordings of lessons without prior written permission from Brightmore Tutoring Ltd.
  • Lesson recordings must not be downloaded where downloading is not authorised, copied, uploaded, published, distributed or shared with anyone outside the authorised Brightmore programme.
  • While Brightmore takes reasonable safeguarding and security measures, Brightmore cannot completely control or prevent unauthorised screenshots, recordings or sharing carried out independently by students, parents or other third parties participating in online sessions.
  • Parents/guardians with specific safeguarding requirements, anonymity requirements or court-ordered restrictions relating to the recording or display of their child’s image must inform Brightmore Tutoring Ltd in writing before lessons commence.

06

Brightmore Resources

  • All Brightmore worksheets, lesson recordings, homework, revision resources, videos, examinations, Grade 9 Vault materials, Quick Boost videos, revision timetables, teaching frameworks and other educational materials are for the personal educational use of the enrolled student only.
  • Brightmore materials must not be copied, reproduced, sold, uploaded, distributed, published or shared with friends, siblings, other students, external tutors, tuition companies or any other third party without prior written permission.
  • Brightmore resources and programme materials remain the intellectual property of Brightmore Tutoring Ltd or the applicable rights holder.
  • Unauthorised sharing of Brightmore resources, recordings or account access may result in the student’s access being suspended or terminated.

07

Student & Parent Conduct

  • Students must conduct themselves appropriately and respectfully while participating in Brightmore lessons.
  • Bullying, abusive behaviour, discrimination, harassment, deliberate disruption of lessons or inappropriate online behaviour will not be tolerated.
  • Parents/guardians must communicate respectfully with Brightmore tutors, staff and management.
  • Brightmore reserves the right to suspend or remove a student from the programme following serious or repeated misconduct, safeguarding concerns, unauthorised sharing of materials, account sharing, persistent non-payment or another serious breach of these Terms & Conditions.
  • Brightmore also reserves the right to terminate services where a parent/guardian engages in threatening, abusive, discriminatory, harassing or seriously inappropriate behaviour towards a tutor, member of staff, student or representative of Brightmore.
  • Where services are terminated because of a serious breach by the student or parent/guardian, amounts already due remain payable and any further financial liability will be determined in accordance with the agreed programme commitment and applicable UK consumer law.

08

Privacy & Data Protection

  • Personal data is processed in accordance with applicable UK GDPR and Data Protection Act 2018 requirements.
  • Brightmore may process student and parent information including names, contact details, academic information, attendance, homework, assessments, communications and lesson recordings for legitimate educational, safeguarding, administrative, contractual and operational purposes.
  • Brightmore may use appropriate third-party providers, including payment processors and learning platforms, where necessary to provide its services.
  • Brightmore takes reasonable measures to keep personal information and lesson recordings secure and restrict access to authorised persons.
  • Parents/guardians are responsible for informing Brightmore of any safeguarding, legal or privacy restrictions that may materially affect their child’s participation in online tuition.
